In the early 20th century, the Bengal Presidency extended over vast areas of Assam, Bihar, and Orissa. Administering such vast areas with diverse languages and traditions posed significant challenges. Recognizing the administrative complexities, a need arose to separate areas that were not originally part of Bengal.
In 1905, Lord Curzon, with the suspected agenda of creating communal divisions among Bengal’s nationalists, divided Bengal into two sections and created a new province with Assam and East Bengal. Bihar and Orissa remained as the province of Bengal along with the remaining part of Bengal. Curzon’s intentions became clear when he said that the new East Bengal and Assam provinces were envisaged as Muslim-majority.
The partition of Bengal led to nationwide protests, which were strongly opposed by all sections of Bengalis. The intense agitation forced the British to reconsider, leading to the reunification of Bengal. Subsequently, Bihar and Orissa were separated from the Bengal Presidency, forming the new province of Bihar in 1912.
In 1942, the Government of Orissa, recognizing the need for speedy administration of justice, appointed a committee under the chairmanship of Shri Bira Kishore Ray to explore the establishment of a separate High Court. The committee report highlighted the need for a separate High Court for Orissa, emphasizing its organizational and judicial advantages.
Ultimately, the Orissa High Court was inaugurated on 26 July 1948, with Shri Bira Kishore Ray as the Chief Justice and Shri B.Jagannadha Das, Shri L.Panigrahi and Shri R.L.Narasingham Puisne as the Judges, with the then Chief Justice H.J.Judge of the Federal Court of India by Kania. Under the jurisdiction of the Orissa High Court, 30 district courts operate, which contribute to the delivery of justice in the region.
