In Aizawl Court’s historical context, before the British annexation of the territory in 1890, traditional chiefs, with the assistance of village elders, wielded authority over civil and criminal justice matters in the Lushai Hills region. Even post-1890, the ruling chief continued administering justice except for grave offenses such as murder and rape. However, the enactment of the Assam Lushai Hills District (Acquisition of Chiefs’ Rights) Act, of 1954 changed this. The British Government then established rules for justice administration in the region through notifications in 1906 and 1937, whereby civil and criminal justice fell under the jurisdiction of the Superintendent and his assistants.
Over time, various Acts and Rules shaped the judicial landscape of the Aizawl Court. Notably, the Assam Autonomous District (Administration of Justice) Act, of 1960 allowed Additional Deputy Commissioners to oversee judicial matters. Special courts were established under Acts like the Prevention of Corruption Act, of 1988, and the Narcotic Drugs and Psychotropic Substances Act, of 1985.
Furthermore, the establishment of Juvenile Justice Boards, Lok Adalats, Motor Accident Claims Tribunals, and Family Courts catered to specific legal needs within the region. The separation of the judiciary from the executive, a constitutional mandate, underwent a lengthy process in Mizoram, ultimately leading to its realization in 2008.
