After receiving the Dewani rights from the Mughals and following the issuance of the Crown’s Charter, the British streamlined the justice system in British India by establishing a hierarchy of Dewani and Fauzdari Adalats. In the Presidency towns of Calcutta, Bombay, and Madras, the Small Cause Courts were set up under the Charter of King George II, dated 8th January 1753. The jurisdiction of these courts evolved through various enactments, such as Act IX of 1850, later revised by Act XXVI of 1864 and consolidated under Act XV of 1882. These courts, originally established at the request of European traders under the name “Court of Requests,” began with a pecuniary jurisdiction of Rs. 100 and were initiated by the Calcutta Trader’s Association.
Governed by the Presidency Small Cause Courts Act, 1882, and its Manual, these courts resemble the English County Courts and remain some of the oldest judicial establishments in India. Despite the evolution of the legal framework over time, these courts have largely retained their original structure and jurisdiction. Their historical significance lies in their foundation as a response to the needs of European traders, with minimal interference from subsequent legislation.
