The Sikkim High Court was established under the authority of the High Court of Judicature (Jurisdiction and Powers) Proclamation, 1955, also known as ‘Chogyal’, a proclamation issued on 17 April 1955 by the then Maharaja of Sikkim. Historical records show that the administration of justice in Sikkim during the last century was managed by feudal zamindars (Eda courts), Zongpons (district officers), Pipons (chiefs), and Mandals, with Chogyals at the top. In 1909, the Kazis, Thikadars, and Lamas were given judicial powers by a resolution of the State Council, empowering them to handle civil suits up to Rs 500/-.
In 1916, the Appellate Court, later designated as the Chief Court, was established with jurisdiction over significant original suits and appellate jurisdiction over Adda Courts. Following the abolition of Adda Courts in 1949, the state was divided into four Revenue Districts with appointed Magistrates. The journey of the judiciary continued with the establishment of the High Court of Sikkim in 1955, eventually becoming the High Court of Sikkim in 1975 after Sikkim’s merger with India.
The Namchi Courts Complex, in South Sikkim, underwent significant developments, transitioning from a single-storied structure to a multi-storied RCC building inaugurated in 2000. In March 2000, the High Court directed the District & Sessions Court (South & West) to shift its headquarters to Namchi, which commenced operations on April 3, 2000. This complex now houses various judicial offices, including the Court of the Chief Judicial Magistrate cum Civil Judge (South & West), furthering the independence and efficiency of the judiciary in the region.
