The Bombay High Court stands as one of India’s oldest and most significant judicial institutions, situated in Mumbai, Maharashtra. Its jurisdiction encompasses the states of Maharashtra and Goa, along with the Union Territory of Dadra and Nagar Haveli and Daman and Diu. The High Court has branch seats in Nagpur and Aurangabad within Maharashtra, as well as in the capital of Goa, Panaji.
Established under the Charter of 1798, the legal history of Bombay can be traced back to 1661, when the British acquired it as part of the dowry of the Portuguese Princess Catherine of Braganza. At that time, Bombay was a modest fishing village with a sparse population of indigenous Kolis and a harbor that would eventually evolve into one of the most crucial commercial seaports in the East. King Charles II transferred Bombay to the East India Company in 1668 for a nominal annual rent of 10 Pounds.
The judicial administration in Bombay began with the Charter of 1668, marking the transition from Portuguese and earlier Muslim eras. By 1670, Justices held court in the Custom Houses of Bombay and Mahim, operating within a rudimentary system fraught with drawbacks and close ties to the executive government. Gerald Aungier, the Governor of Surat Factory, played a pivotal role in shaping the judicial system during this period, emphasizing impartial justice. Dissatisfied with the existing machinery, Aungier sought to improve the system by appointing George Wilcox as the Judge.
On 8 August 1672, the inaugural session of the First British Court of Justice took place in Bombay, with due pomp and ceremony. Aungier’s efforts marked the foundation of the Bombay High Court, laying the groundwork for its evolution into a respected institution with far-reaching jurisdiction over the years. Today, the High Court operates from its principal seat in Mumbai, with additional benches in Aurangabad, Nagpur, and Panaji.
