The evolution of the judiciary in Sikkim traces back to 1909 when Kazis, Thikadars, and Lamas were granted judicial authority, handling civil suits up to Rs. 500 valuation. By 1916, an Appellate Court, known as the Chief Court, oversaw significant original suits and appeals from the Adda Courts, though final appeals still lay with the Maharaja’s Supreme Court. In 1949, Adda Courts were abolished, and the State was divided into four revenue districts, each with appointed magistrates.
In 1955, the High Court of Judicature was established, marking a significant judicial milestone. Following Sikkim’s merger into India, its existing High Court became the official High Court under Article 371F of the Constitution. The Government of Sikkim Act, 1974, emphasized judicial independence, leading to the separation of the judiciary from the executive. Legislation such as the Sikkim Civil Courts Act (1978) and the establishment of judicial service rules further solidified this independence.
In 1994, the Code of Criminal Procedure was extended to Sikkim, formalizing the separation of the judiciary from the executive branch. These developments reflect Sikkim’s journey towards an autonomous and robust judicial system aligned with constitutional principles.
