In Uttarakhand, District Courts are established by the State Government in consultation with the High Court, considering factors such as case numbers, topography, and population distribution. The highest court in each district is the District and Sessions Judge, with jurisdiction derived from The Bengal, Agra, and Assam Civil Courts Act, 1887, and the Code of Criminal Procedure. Additional District & Sessions Judges manage the workload in some districts. These courts handle civil and criminal cases, including session cases and motor accident claims.
The District & Sessions Judge oversees all Judges/Judicial Magistrates and manages state funds for judicial development. Subordinate courts include Chief Judicial Magistrate, Judicial Magistrate Ist Class, Civil Judge (Senior Division), and Civil Judge (Junior Division). Family Courts, Labour Courts, Consumer Forums, and Juvenile Boards also function in various districts. Legal aid is provided through the District Legal Services Authority, chaired by the District Judge, and the State Legal Services Authority at the High Court in Nainital.
