The concept of Family Courts in India was first proposed by the late Smt. Durga Bai Deshmukh in 1953, after she visited China, where she studied their functioning. She discussed this idea with notable figures such as Justice M.C. Chagla and Justice P.B. Gajendragadkar of the Bombay High Court, as well as with Prime Minister Pandit Jawahar Lal Nehru. The idea gained momentum with support from women’s associations and welfare organizations, aiming to resolve family disputes through a non-adversarial approach focused on conciliation.

Maharashtra Family Courts

The Law Commission’s 59th report (1974) further emphasized the need for specialized courts to handle family matters with simplified procedures. Following these recommendations, the Family Courts Act was passed in 1984, aiming to create a more supportive environment for resolving family and marital disputes. Family Court Mumbai was established on 7 October 1989, initially with five courts, expanding to seven by 1995.
